Abstract

This research aims to study the issue of preferencing without a preponderant evidence in Islamic Sharia, and to understand the role played by certain aspects and rules in achieving social justice. The importance of the study lies in the fact that preferencing contributes to understanding the Sharia-based foundations governing the application of these rulings, ensuring that none is neglected without reason or improperly executed. I have adopted an analytical methodology based on Sharia sources, with a focus on interpreting the texts related to the subject of study. The research is structured into an introduction and three main sections.
